LOL, of course they can get rabies... and distemper, and flu, and lots of other things. It's just not a high enough probability in this area that you can immediately assume it without the animal showing at least one symptom.

Being out during the day is not a symptom here. He was obviously just tired and shagged out following a prolonged chew. For which I am very glad, Rabies is a horrible disease.
